Front Line Defenders
El 16 de agosto de 2012, el Dr Yuri Giovanni Melini
Salguero, los Sres Rudy Pivaral, Oscar Morales y Gustavo
Martínez y la Sra Andrea Marcilia Hernández Melini, defensores de
los derechos humanos, interpusieron un recurso legal con el objetivo de anular
la decisión de carácter provisional de un juez que resolvió que habían cometido
los delitos de "violencia contra la mujer" y "amenazas".
Esta decisión provisional es la más reciente de una serie de tentativas a
criminalizar a los defensores de los derechos humanos que tratan de realizar el
derecho al consentimiento libre, previo e informado en relación con el proyecto
minero de Escobal, ubicado entre San Rafael Las Flores, Santa Rosa, y
Mataquescuintla, Jalapa.
Yuri Melini recibió el Premio Front Line Defenders para Defensores de los Derechos Humanos en Riesgo en 2009 y es el Director del Centro de Acción Legal, Ambiental y Social de Guatemala (CALAS), una organización que trabaja para promover la gestión ambiental, la participación ciudadana y el respeto de los derechos colectivos relacionados con el medio ambiente de los pueblos indígenas. Rudy Pivaral, Oscar Morales, Gustavo Martínez y Andrea Marcilia Hernández Melini son miembros del Comité en Defensa de la Vida y la Paz de San Rafael Las Flores, que promueve la realización de consultas comunitarias en concordancia con el derecho al consentimiento libre, previo e informado.

Luego, el juez puso un apremio a Rafael Maldonado, indicando que el abogado le había difamado y amenazándolo con denunciarlo a las autoridades pertinentes si vuelve a interponer acciones parecidas. Los defensores de los derechos humanos pretenden interponer una nueva impugnación legal el 22 de agosto.

Se llegó a esta conclusión a pesar de que Yuri Melini no conoce a ninguna de las 13 mujeres que presentaron la denuncia y los otros defensores de los derechos humanos mencionados sólo conocen a dos o tres de ellas.
Las querellantes alegan que los defensores de los derechos humanos intentaron obligarlas a salirse de las asociaciones a las que son afiliadas y que sus vidas, así como las de sus familiares inmediatos, están en peligro debido a las amenazas que presuntamente han recibido. Todas las mujeres querellantes afirman que representan organizaciones fundadas después del inicio del proceso para analizar la pertinencia de consultas comunitarias.
Se hicieron varias tentativas de criminalizar a defensores de los derechos humanos que promueven la realización de consultas comunitarias en meses anteriores. El 18 de julio de 2012, se entregó una denuncia contra Andrea Marcilia Hernández Melini al Tribunal del Honor del Colegio de Abogados. La Sra Gloria Cruz Pivaral, la denunciante, alega que Andrea Marcilia Hernández Melini se extralimitó en sus funciones cuando mencionó el término "la sociedad civil" en la redacción de un acta notarial con relación a una junta entre personas que promuevan la realización de consultas comunitarias.
Además, el 25 de abril de 2012, se presentó una denuncia por usurpación de funciones en contra de Rudy Pivaral y Oscar Morales ante la Fiscalía de Delitos Administrativos. La denunciante alega que los defensores de los derechos humanos cometieron un delito por representar la sociedad civil en la comisión creada para el análisis de la solicitud de consulta comunitaria. Ambas de estos casos permanecen abiertos.
El 12 de abril de 2012, se presentó una acción de amparo contra el Padre Néstor Melgar, quien fue presentado como el representante de la población local en su solicitud a las autoridades locales para una consulta con la gente viviendo en los alrededores de San Rafael Las Flores acerca del proyecto minero. A pesar de que sólo las acciones desarrolladas por autoridades públicas, y no de personas en lo particular, pueden ser objeto de una acción de amparo, la Jueza Ligia Aracely Pérez Véliz tramitó la acción y dio a la autoridad acusada un plazo para pronunciarse. Posteriormente, el Tribunal de Amparo cerró el expediente.
En octubre de 2011, el defensor de los derechos humanos el Sr Amadeo de Jesús Rodríguez Aguilar, líder del Comité Local en Defensa de la Vida, fue acusado de "secuestro". Esta denuncia fue hecha después de que él interrumpió una reunión entre accionistas de las empresas extranjeras que financian el proyecto minero y sus representantes locales para explicar a los accionistas en inglés algunos de los problemas proviniendo del proyecto.
Front Line Defenders considera que las tentativas de criminalizar a los defensores de los derechos humanos mencionados está directamente relacionado con su trabajo legítimo y pacífico en defensa de los derechos humanos, particularmente sus esfuerzos para realizar el derecho al consentimiento libre, previo e informado en relación con el proyecto minero de Escobal. Front Line Defenders expresa su preocupación por lo que percibe como una estrategia clara empleada por ciertos actores que quisieran impedir las consultas comunitarias, que pretende deslegitimizar los defensores de los derechos humanos a través de crear la impresión de que no representan la comunidad en general y acusarlos de actos delictivos.
Front Line Defenders insta a las autoridades guatemaltecas a que:
1. Anulen de inmediato todos los cargos formulados contra los defensores de los derechos humanos mencionados ya que a nuestro entender estas medidas son consecuencia de su labor legítima y pacífica en defensa de los derechos humanos;
2. Inicien una investigación inmediata, exhaustiva e imparcial sobre las tentativas repetidas de criminalizar a defensores de los derechos humanos que tratan de realizar el derecho al consentimiento libre, previo e informado, y tomen todas las medidas necesarias para evitar que el sistema jurídico sea utilizado con el único objetivo de restringir la labor de estos defensores de los derechos humanos;
3. Aseguren que todos los defensores de derechos humanos en Guatemala, desarrollando sus actividades legítimas en defensa de los derechos humanos, puedan operar libremente sin miedo a restricciones ni represalias.

Re: Guatemala - Repeated attempts to criminalise human rights defenders

initiated legal proceedings aimed at overturning the provisional ruling of a
judge which declared that they had committed the crimes of "violence
against women" and "threats". This provisional ruling is the
latest in a series of attempts to criminalise human rights defenders seeking to
realise the right to free, prior and informed consent in relation to the
Escobal Mining Project, located between San Rafael Las Flores, Santa Rosa, and
Mataquescuintla, Jalapa.
Yuri Melini was the recipient of the 2009 Front Line Defenders Award for Human Rights Defenders at Risk and is the Director of Centro de Acción Legal, Ambiental y Social de Guatemala - CALAS (the Centre for Legal, Environmental and Social Action in Guatemala), an organisation which works to promote environmental issues, community participation and respect for the collective rights of indigenous communities in relation to environmental concerns. Rudy Pivaral, Oscar Morales, Gustavo Martínez and Andrea Marcilia Hernández Melini are members of the Comité en Defensa de la Vida y la Paz de San Rafael Las Flores (Comittee in Defence of Life and Peace in San Rafael Las Flores), which promotes the carrying out of community consultations in accordance with the right to free, prior and informed consent.
On 16 August 2012, Mr Rafael Maldonado, a member of CALAS and the legal representative of the aforementioned human rights defenders, submitted a motion for review to Judge Estuardo de Jesús Barrientos Archila, Justice of the Peace of San Rafael Las Flores. It was subsequently rejected by the judge, in contravention of the law, who argued that he did not have to hear the case. The judge went on to issue a writ against Rafael Maldonado, saying that the lawyer had slandered him and threatening to report him to the relevant authorities should he initiate similar actions in the future. The human rights defenders plan to submit a fresh legal challenge on 22 August.

This conclusion was arrived at in spite of the fact that Yuri Melini has never met any of the 13 women who lodged the official request for protective measures and the other aforementioned human rights defenders are only acquainted with two or three of them.
The complainants allege that the human rights defenders attempted to force them to leave the associations they are affiliated with and that their lives, and the lives of their immediate family members, are at risk due to threats they have allegedly received. Each of the complainants claim that they represent organisations established following the commencement of the process analysing the appropriateness of community consultations.
A number of attempts to criminalise human rights defenders who promote the carrying out of community consultations were made in previous months. On 18 July 2012, a complaint against Andrea Marcilia Hernández Melini was made to the Honour Tribunal of the Bar Association. Ms Gloria Cruz Pivaral, the complainant, claims that Andrea Marcilia Hernández Melini exceeded her authority when she included the term "civil society" in the drawing up of a notarial deed pertaining to a meeting of people that promote the holding of community consultations.
Moreover, on 25 April 2012, a complaint of "usurpation of functions" was made against Rudy Pivaral and Oscar Morales to the Public Prosecutor for Administrative Crimes. The complainant alleges that the human rights defenders committed an offence by representing civil society at the commission established to analyse the appropriateness of the request for community consultations. Both of these cases remain open.

Notwithstanding the fact that only the actions of public authorities, and not of private individuals can be the subject of a writ of amparo, Judge Ligia Aracely Pérez Véliz processed the writ and gave the indicted authority a period of time to respond. The Amparo Tribunal subsequently closed the case.

Front Line Defenders believes that the attempts to criminalise the aforementioned human rights defenders is directly related to their legitimate and peaceful work in defence of human rights, particularly their efforts to realise the right to free, prior and informed consent in relation to the Escobar Mining Project. Front Line Defenders is concerned by what it perceives to be a clear strategy being employed by certain actors who wish to block community consultations, which aims to delegitimise human rights defenders by creating the impression that they do not represent the wider community and by accusing them of criminal acts.
Front Line Defenders urges the authorities in Guatemala to:
1. Immediately drop all charges against the above-mentioned human rights defenders as it is believed that these measures have been taken against them solely on account of their legitimate and peaceful work in defence of human rights;
2. Carry out an immediate, thorough and impartial investigation into the concerted efforts being made to criminalise human rights defenders seeking to realise the right to free, prior and informed consent, and take all necessary steps to prevent the judicial system from being used with the sole aim of restricting the work of these human rights defenders;
3. Guarantee in all circumstances that all human rights defenders in Guatemala are able to carry out their legitimate human rights activities without fear of reprisals and free of all restrictions including judicial harassment.
